For companies and e-commerce businesses that operate in the international market and that source products and raw materials from non-European countries, keeping up with the regulations relating to the movement of goods is an aspect of fundamental importance.

With the introduction of the new ICS2 system, the rules for managing customs practices have changed significantly. But what is ICS2 and how does this regulation impact the organization and development possibilities of companies? Let us look at it together.

What ICS2 is and what its objectives are

The Import Control System 2 is the new customs system of the European Union, introduced through various steps starting from 2021 until June 2024 with the aim of improving the safety of goods arriving in or transiting the European territory. A central electronic system of preventive information thus allows the data of goods arriving from third countries - not part of the safety area formed by the 27 EU countries, Switzerland, Norway and Northern Ireland - to be collected before their arrival. The main objective of ICS2, therefore, is to make EU borders safer, improving the traceability of shipments and ensuring that all goods comply with current regulations.

According to data released by Eurostat, in August 2024 alone, goods worth over 212 billion euros entered the EU, with China being the leading import partner, with almost 520 billion euros of goods imported last year. The problems related to counterfeiting, and therefore to safety, concern numerous types of goods, from pharmaceutical products to clothing, from footwear to children's toys. The latest annual report published by the EUIPO quantifies the number of counterfeit items detained and seized in the EU as they do not comply with intellectual property regulations at around 86 million. For companies and e-commerce, this means having to face some challenges, but also having the opportunity to make their operations more efficient and build a stronger relationship of trust with consumers.

According to data released by Eurostat, in August 2024 alone, goods worth over 212 billion euros entered the EU.

EUIPO estimates that approximately 86 million counterfeit items are detained and seized in the EU because they are not compliant.

ICS2 Procedure: The Documents required

Goods entering the European security area must therefore have documentation compliant with the regulations, under the threat of slowing down procedures and possible sanctions. This must include:

Entry Summary Declaration (ESD)

- Accurate description of the goods: each item of the shipment must be described in detail.

- HS (Harmonized System) code: a harmonized code of at least six digits for each item of the shipment.

- Full address of the sender and recipient: detailed information on who sends and who receives the goods.

- EORI (Economic Operator Registration and Identification) code: the registration and identification code of the economic operator of the recipient.

Security and Protection information

- Safety & security data, information necessary for the risk assessment of the goods contained in the shipment.

Logistics information

- Details on the means of transport used (air, sea, land) and the routes taken.

Submission procedure

- Economic operators wishing to comply with ICS2 must submit ENS through the shared interface for traders, using the Graphical User Interface (GUI) or in System-to-System mode. This process ensures that all information is correctly recorded and accessible to customs authorities.

Why ICS2 is important for e-commerce

ICS2 has a significant impact not only on security and compliance, but also on the operational efficiency and competitiveness of a business. Here are some of the main reasons why this compliance is essential:

Compliance and security. Ensuring that all goods entering the EU comply with safety regulations reduces the risk of illicit trafficking and increases consumer confidence in the quality of the products offered. Companies that can ensure high standards can strengthen their position in the market.

Reduction of delays. Providing detailed information about shipments in advance allows authorities to carry out checks faster, avoiding delays due to incorrect or incomplete certifications during the checks on customs documentation. This meas a better experience for the customer, who receives the products faster. In addition, companies can plan their operations better, reducing downtime and optimizing available resources.

Optimization of logistics processes. Properly implementing ICS2 means improving logistics planning, reducing bottlenecks and increasing the overall efficiency of operations. Efficient logistics can become a major competitive advantage, especially in the e-commerce sector where customer expectations in terms of speed and accuracy of deliveries are very high.

It is therefore essential for small and medium-sized enterprises to work with non-European business partners who work in accordance with the ICS2 system. Companies that adapt quickly can prove to be reliable partners for customers and logistics operators.
